Looking at official data for 2009 and 2010, the largest share in recorded incidents is held by right wing extremist incidents; racist/xenophobic, anti-Semitic and anti-Islamic incidents recorded account for a considerably smaller proportion (e.g. in 2009 356 right wing extremist vs. 49 xenophobic/racist, 12 anti-Semitic, zero anti-Islamic incidents). In 2010, a total of 580 right wing extremist, xenophobic, racist, islamophobic, anti-Semitic and other related offences were recorded. An offence can consist of several incidents. 282 offences could be solved (48.6 per cent). Out of 580 offences there were 57.8 per cent right wing extremist, 11 per cent xenophobic/racist, 4.6 per cent anti-Semitic and 1.4 per cent anti-Islamic motivated. The motivation concerning the remaining 25.2 per cent was either unclear or amibiguous.
It emerges that the number of officially recorded incidents is lower than the number of incidents based on unofficial sources: the NGO ZARA documented for 2009 798 and for 2010 745 racist (incl. religiously motivated) incidents; the NGO Helping Hands Graz documented 392 and in 2010 389 incidents. In comparison, in 2009 the official figure for racist/xenophobic, anti-Islamic and anti-Semitic incidents is 61; after adding right wing extremist incidents and ‘other’ incidents, the total amount is 453 and in 2010 580 incidents.

There are convictions because of incitement to hatred and under the prohibition law.

In 2010, nine persons were condemned because of Sec. 283 (1) Criminal Code which makes Verhetzung (incitement to hatred) a punishable offence and three persons were discharged. 40 persons were condemned under Sect. 31 ff Prohibition Law (Verbotsgesetz - covering national socialist offences).

In 2010, the Equal Treatment Commission examined a total of 62 cases concerning discrimination on grounds of ethnic origin. In 2011 the ETC examined 75 cases. During the last five years there were 13 cases against Austria according to article 14 before the European Court of Human Rights.

According to the Equal Treatment Act there are two bodies responsible for dealing with ethnic discrimination in the private sector: The Ombud for Equal Treatment Irrespective of Ethnic Belonging, Religion and Belief, Age and Sexual Orientation in Employment (OET II) and the Ombud for Equal Treatment Irrespective of Ethnic Belonging in Other Areas and for Equal Treatment of Men and Women in Goods and Services (OET III). In 2008, the OET II received 156 inquiries concerning ethnic discrimination, that is 32 per cent of the total amount of inquiries addressed to the OET II. The OET III received 322 inquiries or complaints on grounds of ethnic discrimination. 20 per cent thereof concerned issues of housing, 8 per cent health insurance, retirement pension insurance and other issurance issues, 11 per cent transport, 5 per cent real estate advertisments, 2 per cent banking, 15 percent shops and bars, 10 per cent administrative offices, 8 per cent schools and scholarships and 21 per cent other topics.

In 2010, the Senate I of the Equal Treatment Commission (equal treatment between men and women in the employment area) examined 36 cases, the Senate II (equal treatment irrespective of ethnic belonging, religion, belief, age and sexual orientation in the employment area) 17 cases and the Senate III (equal treatment irrespective of gender or ethnic belonging in other areas) 9 cases concerning ethnic origin or multiple discriminatin including ethnic origin.
In 2011, Senate I examined 49 cases, Senate II 14 cases and Senate III 12 cases.
