Although legislation does not contain any specific measures falling into the category of positive action, the establishment of the Alto Comissariado para a Imigração e Minorias Étnicas (ACIME) [High Commission for Immigration and Ethnic Minorities], namely Law 18/2004 and Decree-law 167/2007, of 3 May 2007 regulating the scope of its intervention, opened the door to that kind of measures. Article 8(1) of Law 18/2004 states that it is up to the High Commissioner to promote equality of treatment among all persons, without any discrimination based on racial or ethnic origin. Article 3(2)(a)(b)(c) of Decree-law 167/2007, of 3 May 2007, states that it is within the competence of the High Commissioner to cooperate in creating and implementing active policies of social integration as well as combating the exclusion of immigrants and ethnic minorities, in particular by stimulating transversal cooperation between public administration and municipalities. |
