Law on Combating Certain Forms and Expressions of Racism and Xenophobia by means of Criminal Law N.134(I)/2011, transposing Council Framework Decision 2008/913/JHA provdes the following definitions (article 2): “descent" means persons or groups of persons who descend from persons who could be identified by certain characteristics such as race or colour, whether or not these characteristics continue to exist today. “Hatred" means hatred based on race, colour, religion, descent or national or ethnic origin. No definition of racist crime as such is provided, but the description of offences in the above law may well be interpreted as defining racist crime. |
